KCMO employers take note: Oct.31, 2019 is the effective date of the City’s ban on salary history inquiries. It applies to any KCMO employer with six or more employees.
What does it mean? It means employers are prohibited from:
- Inquiring about an applicant’s salary history
- Screening applicants based on their current or previous wages or other compensation
- Maintaining any requirement that prior wages meet minimum or maximum criteria
- Using past wage information to determine whether to offer an applicant a position or determine the applicant’s compensation
- Retaliation of any type
Are there other implications? Of course!
Be very careful if you conduct employment verifications or background checks directly or through a third-party. If doing so produces salary history information, don’t use it in ways the Ordinance prohibits.
Finally, there are a few exceptions or exclusions to the ban, such as internal applicants, rehires (within five years), and employees whose compensation is determined through collective bargaining agreements.
